American Young Leader Exchange (“us”, “we”, or “our”) operates the American Young Leader Exchange website (the “Service”).

  • To facilitate account creation and logon process.
  • To post testimonials. We post testimonials on our Website that may contain personal information. Prior to posting a testimonial, we will obtain your consent to use your name and the consent of the testimonial. If you wish to update or delete your testimonial, then please contact us at info@aylx.org and be sure to include your name, testimonial location, and contact information.
  • To facilitate the application process, such as the SSNs of a potential host family’s household adults to run criminal background checks. 
  • Request feedback. We may use your information to request feedback and to contact you about your use of our Website.
  • To enable user-to-user communications. We may use your information in order to enable user-to-user communications with each user’s consent.
  • To manage user accounts. We may use your information for the purposes of managing our account and keeping it in working order.
  • To deliver and facilitate the delivery of services to the user. We may use your information to provide you with the requested service.
  • To respond to user inquiries/offer support to users. We may use your information to respond to your inquiries and solve any potential issues you might have with the use of our Services.
  • To send you marketing and promotional communications. We and/or our third-party marketing partners may use the personal information you send to us for our marketing purposes if this is in accordance with your marketing preferences. For example, when expressing an interest in obtaining information about us or our Website, subscribing to marketing, or otherwise contacting us, we will collect personal information from you. You can opt out of our marketing emails at any time.
  • Deliver targeted advertising to you. We may use your information to develop and display personalized content and advertising (and work with third parties who do so) tailored to your interests and/or location and to measure its effectiveness.

Children’s Privacy

Protecting the privacy of children is especially important. For that reason, we comply in all respects with the Children’s Online Privacy Protection Act (“COPPA”) and do not knowingly solicit, request or collect personal information from individuals under the age of 13.

California Resident Specific Privacy Rights

California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us using the contact information provided below.

If you are under 18 years of age, reside in California, and have a registered account with the Website, you have the right to request the removal of unwanted data that you publicly post on the Website. To request the removal of such data, please contact us using the contact information provided below, and include the email address associated with your account and a statement that you reside in California. We will make sure the data is not publicly displayed on the Website, but please be aware that the data may not be completely or comprehensively removed from all our systems (e.g. backups, etc.).

CCPA Privacy Notice

The California Code of Regulations defines a “resident” as:

  • every individual who is in the State of California for other than a temporary or transitory purpose and
  • every individual who is domiciled in the State of California who is outside the State of California for a temporary or transitory purpose

What categories of personal information do we collect?

We have collected the following categories of personal information. 

  • Identifiers – Contact details, such as real name, alias, postal address, telephone or mobile contact number, unique personal identifier, online identifier, Internet Protocol address, email address and account name
  • Personal information categories listed in the California Customer Records statute – Name, contact information, education, employment, employment history and financial information. 
  • Protected classification characteristics under California or federal law – Gender and date of birth
  • Internet or other similar network activity – Browsing history, search history, online behavior, interest data, and interactions with our and other websites, applications, systems, and advertisements
  • Geolocation data – Device location
  • Audio, electronic, visual, thermal, olfactory, or similar information – Images and audio, video or call recordings created in connection with our business activities
  • Professional or employment-related information – Business contact details in order to provide you our services at a business level, job title as well as work history and professional qualifications if you apply for a job with us
  • Education Information – Student records and directory information
  • Inferences drawn from other personal information – Inferences drawn from any of the collected personal information listed above to create a profile or summary about, for example, an individual’s preferences and characteristics

 

We may also collect other personal information outside of these categories in instances where you interact with us in-person, online, or by phone or mail in the context of:

  • Receiving help through our customer support channel
  • Participation in customer surveys or contests; and
  • Facilitation in the delivery of our Services and to respond to your inquiries

Will your information be shared with anyone else?

We may disclose your personal information with our service providers pursuant to a written contract between us and each service provider. Each service provider is a for-profit entity that processes the information on our behalf.

We may use your personal information for our own business purposes, such as for undertaking internal research for technological development and demonstration. This is not considered to be “selling” of your personal data.

AYLX has not disclosed or sold any personal information to third parties for a business or commercial purpose in the preceding twelve (12) months. AYLX will not sell personal information in the future belonging to website visitors, users, and other consumers.

Your rights with respect to your personal data

Right to request deletion of the data – Request to delete

You can ask for the deletion of your personal information. If you ask us to delete your personal information, we will respect your request and delete your personal information, subject to certain exceptions provided by law, such as (but not limited to) the exercise by another consumer of his or her right to free speech, our compliance requirements resulting from a legal obligation or any processing that may be required to protect against illegal activities.

Right to be informed – Request to know

Depending on the circumstances, you have a right to know:

  • whether we collect and use your personal information;
  • the categories of personal information that we collect;
  • the purposes for which the collected personal information is used;
  • whether we sell your personal information to third parties;
  • the categories of personal information that we sold or disclosed for a business purpose;

  • In accordance with applicable law, we are not obligated to provide or delete consumer information that is de-identified in response to a consumer request or to re-identify individual data to verify a consumer request.

We will not discriminate against you if you exercise your privacy rights.

Verification process

Upon receiving your request, we will need to verify your identity to determine you are the same person about whom we have the information in our system. These verification efforts require us to ask you to provide information so that we can match it with the information you have previously provided us. For instance, depending on the type of request you submit, we may ask you to provide certain information so that we can match the information you provide with the information we already have on file, or we may contact you through a communication method (e.g. phone or email) that you have previously provided to us. We may also use other verification methods as the circumstances dictate.

We will only use personal information provided in your request to verify your identity or authority to make the request. To the extent possible, we will avoid requesting additional information from you for the purposes of verification. If, however, if we cannot verify your identity from the information already maintained by us, we may request that you provide additional information for the purposes of verifying your identity, and for security or fraud-prevention purposes. We will delete such additionally provided information as soon as we finish verifying you.

Other privacy rights

  • you may object to the processing of your personal data
  • you may request correction of your personal data if it is incorrect or no longer relevant, or ask to restrict the processing of the data
  • you can designate an authorized agent to make a request under the CCPA on your behalf. We may deny a request from an authorized agent that does not submit proof that they have been validly authorized to act on your behalf in accordance with the CCPA.
  • you may request to opt-out from future selling of your personal information to third parties. Upon receiving a request to opt-out, we will act upon the request as soon as feasibly possible, but no later than 30 days from the date of the request submission.

Service Providers

We may employ third-party companies and individuals to facilitate our Service, to provide the Service on our behalf, to perform Service-related services, or to assist us in analyzing how our Service is used.

These third parties have access to your Personal Information only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.

Security

We have implemented appropriate technical and organizational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security, and improperly collect, access, steal, or modify your information. Although we will do our best to protect your personal information, the transmission of personal information to and from our Website is at your own risk. You should only access the Website within a secure environment.

Donation Processing

AYLX Inc uses Fundraise Up as an online donation platform. All donation data collected is subject to the provisions of the General Data Protection Regulation (“GDPR”), the California Consumer Privacy Act of 2018 (“CCPA”), and other applicable privacy laws. Non-Personal Information that is collected remains anonymous or non-personally identifiable. All Personally Identifiable Information (PII) is encrypted. Financial information such as banking information or credit card number, name, CVV code or date of expiration, is collected and stored by a third party payment processor. Financial information is not stored by Fundraise Up. When making a donation, information collected may include:

  • Contact and account information such as name, email address, physical address, location data, phone number, and social media information;
  • Technical information collected. Such information may include standard web log entries that contain IP address, cookies (first party, third party, session, persistent, and flash), web beacons, page URL and timestamp.

    Links To Other Sites

    Our Service may contain links to other sites that are not operated by us. If you click on a third-party link, you will be directed to that third party’s site. We strongly advise you to review the Privacy Policy of every site you visit.

    We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.

    Reviewing, Changing, or Deleting Your Information

    You can access personal information online by providing your email and password when prompted at the login. We use this procedure to better safeguard your information. If you would at any time like to review or change the information in your account, you can log in to your account settings and update your user account.

    Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, we may retain some information in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our Terms of Use and/or comply with applicable legal requirements. To protect your privacy and security, we will also take reasonable steps to verify your identity before granting access or making corrections.
